Miami Dade denies LOA-FLA payroll

has been referred to my attention for review and response. As you realizethe Dade County PBA is the exclusive certified collective bargainingunit representative for Miami-Dade County's Police Officers,Correctional Officers and various support personnel. As such they areresponsible for representing these bargaining unit employees in allmatters that relate to their terms and conditions of employment withMiami-Dade County.Several years ago the PBA filed an Unfair Labor Practice charge againstthe County for providing dues deductions for a fraternal organizationthat was infringing upon their exclusive representation rights ofbargaining unit employees. This charge was sustained by the PublicEmployee Relations Commission which ordered the County to cease anddesist from providing due deductions for this organization.Accordingly, the County has maintained the position of not approving any new requests for dues deductions from organizations that contain PBAbargaining unit employees.However you may, if you so desire, contact Mr. John Rivera, President of the Dade County PBA, to discuss your fraternal organization's goals andobjectives. The County must receive written assurance from the PBA that granting dues deductions to Latino Officers of Florida would not resultin the filing of any grievances or Unfair Labor Practice charges against the County. In the absence of this assurance from the PBA, your request for dues deduction must be respectfully denied. This position has theconcurrence of the County Attorneys Office.Alternatively, as we have advised similarly situated organizations, youmay contact an entity such as the Dade County Federal Credit Union todiscuss the possibility of arranging an automatic deduction from yourmembers credit union accounts. Regarding the denial of the deduction for your organzation, was an EEOC complaint filed ? Since other fraternal associations have that right and LOA is being denied possibly due to its active role within the department it might fall under a EEOC violation .If the Public Employee Relations Commission is anything like some other departments, then their decision should be taken with a grain of salt,and appeal the case .

NYPD- NLOA Chapter supports the Fla-NLOA Chapter .
